Welcome to KillScore. These Terms of Service constitute a legally binding agreement between you (whether individually or on behalf of an entity) and KillScore regarding your access to and use of our platform, APIs, decision engine, and related services.
By accessing or using KillScore, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
1. Description of Service
KillScore operates a deterministic market analytics engine designed for game concepts. The platform processes user-submitted text and visual parameters against public market data, including a live index of 127,000+ Steam titles, to calculate positioning metrics and deliver automated evaluation scores.
2. User Accounts and Eligibility
- Eligibility: You must be at least 18 years of age or the legal age of majority in your jurisdiction to create an account and use KillScore.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.
- Accuracy: You agree to provide accurate, current, and complete information during registration and keep your account details updated.
3. Intellectual Property Rights
- Your Submissions: You retain full ownership and all intellectual property rights to the game concepts, descriptions, text parameters, screenshots, and key art you submit to KillScore.
- Our Platform: KillScore retains all ownership rights, title, and interest in and to the platform, including its algorithmic models, Vision AI infrastructure, database architecture, scoring methodology, software, trademarks, and user interface design.
- Generated Reports: You are granted a non-exclusive, worldwide, royalty-free license to use, reproduce, and export the analysis reports generated for your submitted concepts for internal business, pitching, or strategic planning purposes.
4. Acceptable Use and Restrictions
You agree not to engage in any of the following prohibited activities:
- Reverse engineering, decompiling, or attempting to extract the underlying source code or algorithms of KillScore.
- Utilizing automated scripts, bots, or scrapers to extract data from our decision engine or platform without prior written consent.
- Submitting malicious code, viruses, or content that infringes upon the intellectual property or privacy rights of third parties.
- Reselling, sublicensing, or redistributing access to the KillScore engine to unauthorized third parties without an active Enterprise or Institutional plan.
5. Payments, Credits, and Cancellations
- Billing: Access to analysis features, credits, and subscription plans requires valid payment through our authorized payment processors. All fees are quoted and processed in USD unless stated otherwise.
- Refund Policy: Due to the real-time computational costs associated with processing market databases and running AI models, purchased credits and processed reports are non-refundable once an analysis has been initiated.
- Subscription Management: Subscriptions renew automatically based on your selected billing cycle (monthly or annually) until cancelled. You may cancel your subscription at any time via your Account Dashboard prior to the next billing date.
6. Disclaimer of Warranties and Financial Advice
- No Investment Advice: KillScore provides market analytics and probabilistic evaluations based on historical and current market data. Scores and verdicts (BUILD, PIVOT, KILL) do not constitute financial, investment, or legal advice. Commercial outcomes in the video game industry depend on execution, timing, and market dynamics beyond automated analysis.
- As-Is Provision: The platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including fitness for a particular purpose or error-free operation.
7. Limitation of Liability
To the maximum extent permitted by applicable law, KillScore and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of your access to or inability to use the service.
In no event shall KillScore's total aggregate liability exceed the total amount paid by you to KillScore during the twelve months preceding the claim.
8. Termination
We reserve the right to suspend or terminate your account and access to the platform at our discretion, without prior notice, if you violate these Terms of Service or engage in fraudulent or abusive activities. You may terminate your account at any time by contacting [email protected].
9. Governing Law and Amendments
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KillScore is incorporated, without regard to its conflict of law principles.
- Changes to Terms: We reserve the right to update these Terms at any time. Continued use of the platform following published changes constitutes your acceptance of the revised Terms.
